By accessing or using our websites (xamforge.com and xamforge.in), mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

At XamForge, protecting your privacy is our top priority. We collect only the minimum information necessary to deliver our Services and store it securely using Google's industry-leading cloud infrastructure, which provides enterprise-grade security, encryption, and compliance certifications.

4.1 Collection of Personal Information

When you sign up using Google Sign-In, we collect only: your name, email address, and the publicly accessible profile image URL provided by Google. We do not collect or access any other personal details, such as mobile number, physical address, age, or location data.

This minimal information is securely stored in Google Cloud Platform services, helping us maintain our database, track your progress, enable personalized features, and provide better services.

4.2 Use of Personal Information

We use your data solely to operate and improve Services—authenticating accounts, displaying profile images, sending updates, and showing progress dashboards. All processing occurs within Google's secure ecosystem and complies with India's Digital Personal Data Protection Act, 2023.

4.3 Sharing of Personal Information

We do not sell, trade, or share your data. It remains protected within Google's cloud services and is only accessed by authorized XamForge personnel or vetted service providers under strict confidentiality agreements.

4.4 Data Security

Your data benefits from Google Cloud's robust security measures, including:

• End-to-end encryption at rest and in transit
• Advanced threat detection and DDoS protection
• ISO 27001, SOC 2/3, and GDPR compliance certifications
• 24/7 monitoring and automated security updates

While we implement these world-class protections, no system is 100% impervious to breaches.

5. User Responsibilities

You agree to use the Services responsibly, in compliance with these Terms, applicable laws, and any posted guidelines. You must provide accurate information during registration and keep it updated.

6. Account Security

You are responsible for safeguarding your account credentials. Use strong, unique passwords and enable two-factor authentication where available. Notify us immediately at support@xamforge.comof any unauthorized access or security concerns.

We are not liable for losses due to compromised credentials if you fail to secure your account.

7. Prohibited Conduct

You agree not to engage in any of the following activities:

• Using the Services for illegal, fraudulent, or unauthorized purposes
• Attempting to interfere with, disrupt, or overload our servers, networks, or Services
• Uploading, transmitting, or distributing malware, viruses, harmful code, or abusive content
• Gaining or attempting unauthorized access to accounts, systems, or data of other users or XamForge
• Misusing assessments, tools, or features (e.g., cheating, manipulating results, or creating multiple accounts to abuse limits)
• Impersonating others or posting false information
• Scraping, copying, or reverse-engineering any part of the Services without permission

8. Shipping Policy (Not Applicable)

XamForge offers exclusively online and digital services. We do not sell, ship, or deliver physical products, so no shipping, delivery, or related policies apply.

9. Payments, Cancellation, and Refund Policy

All payments are processed securely via trusted third-party providers. By purchasing, you agree to the displayed pricing, taxes, and terms. Paid features are typically activated immediately upon successful payment.

9.1 Cancellation

Subscriptions or services can be canceled via your account dashboard. However, once a digital service has been accessed, downloaded, or used (even partially), cancellation may not be possible due to its consumable nature.

9.2 Refunds

Refunds are considered only within 1 day (24 hours) of payment and if the service remains unused. Eligibility is determined case-by-case; no refunds for consumed digital content.

9.3 Refund Processing Time

Approved refunds take 20–30 business days to process, depending on your payment provider and bank.

10. Termination

We may suspend or terminate your account for violations of these Terms, with or without notice. You may also terminate your account anytime via settings, but this does not entitle you to refunds for prior payments.

11. Disclaimer of Warranties

Services are provided "as-is" without warranties of any kind, express or implied, including accuracy, reliability, or uninterrupted availability. Content like assessments or results is for informational purposes only.

12. Limitation of Liability

To the maximum extent permitted by law, XamForge is not liable for indirect, incidental, consequential, or punitive damages, including data loss or lost profits, arising from your use of the Services.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict of laws principles. Disputes shall be resolved exclusively in the courts of [City, e.g., New Delhi], India.
